App Terms

Terms of Use for MicroStreams Apps

These Terms of Use ("Terms") govern your use of the iOS and macOS apps published by MicroStreams LLC ("MicroStreams," "we," "us," or "our") — including School Avoid, Calendar Split, Selects, Reframe, DiamondSky, and the MicroStreams plugin suite for Motion and Final Cut Pro. These Terms are separate from the MicroStreams Platform Terms of Service. By installing or using any of our apps, you agree to these Terms.

1. Standard EULA for App Store apps

Apps distributed through Apple's App Store or Mac App Store are licensed to you under Apple's Licensed Application End User License Agreement(the "Standard EULA"), in addition to these Terms. Where Apple's Standard EULA and these Terms differ, the Standard EULA controls for App Store and Mac App Store distributions. The sections below supplement and clarify the Standard EULA and cover apps we distribute outside the App Store.

2. License grant

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use our apps on devices you own or control, for personal or commercial use, subject to these Terms. You may not sublicense, rent, lease, or redistribute the apps.

3. Your responsibilities

  • Use the apps in compliance with all applicable laws.
  • Do not use the apps to infringe on any copyright, trademark, or other intellectual property rights. You are responsible for having the rights to any media you import into Selects, Reframe, DiamondSky, or our plugins.
  • Do not attempt to reverse-engineer, decompile, or circumvent any protection mechanisms, except to the limited extent permitted by law.
  • Do not use the apps to build or enhance any competing product or service.
  • Keep any third-party API keys you enter confidential. You are responsible for charges incurred on those third-party services.

4. Schedule data in School Avoid

School Avoid provides bell schedule information for U.S. schools based on public school directory data and schedules published by individual districts. We work hard to keep schedule data accurate, but bell schedules can change on short notice and may contain errors.

Do not rely solely on School Avoid for situations where exact timing matters. Always confirm critical school information (pickup times, closures, emergency changes) directly with the school. School Avoid is a traffic-avoidance aid, not an authoritative source.

5. Third-party services

Some features in our apps optionally integrate with third-party services you configure with your own credentials (for example, the Anthropic, Deepgram, or ElevenLabs APIs). These services are provided by third parties under their own terms. MicroStreams is not responsible for:

  • Availability, accuracy, or quality of third-party service output.
  • Charges or fees you incur on those services.
  • How those services process or retain the data you send them.

You are responsible for complying with each third-party service's terms.

6. Your content

You retain all rights to the media, project files, calendars, and other content you import into our apps. We do not claim any ownership or license over your content. Because our apps process content on your device, we never receive it.

7. Updates and changes

We may release updates to the apps that add, modify, or remove features. Major platform changes from Apple (new OS versions, API deprecations) may require a minimum OS version to keep running the latest builds. We will make reasonable efforts to document such requirements in the App Store listing.

8. Disclaimer of warranties

The apps are provided "as is" and "as available." To the maximum extent permitted by law, MicroStreams disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. No advice or information obtained from the apps creates any warranty not expressly stated here.

9. Limitation of liability

To the maximum extent permitted by law, MicroStreams LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including damages for lost profits, lost data, missed events, or damage to media — arising out of or related to your use of the apps. For paid apps, our total aggregate liability for any claim will not exceed the amount you paid for the app in the 12 months preceding the claim. For free apps, our total aggregate liability will not exceed US $50.

10. Indemnification

You agree to indemnify, defend, and hold harmless MicroStreams LLC and its owners and employees from any third-party claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the apps in violation of these Terms, your infringement of any third party's rights, or your violation of any applicable law.

11. Termination

These Terms apply for as long as you use the apps. You may stop at any time by uninstalling them. We may revoke the license granted in these Terms if you materially breach them. Sections that by their nature should survive termination (disclaimers, limitation of liability, indemnification, governing law) will survive.

12. Apple as third-party beneficiary

For apps distributed through Apple's App Store or Mac App Store, you acknowledge that Apple is a third-party beneficiary of these Terms and may enforce them against you. This Section is required by Apple's developer agreement and is in addition to the Standard EULA.

13. Changes to these Terms

We may update these Terms as our apps evolve. When we do, we will update the "Last updated" date above. Material changes will be described in the app or on this page. Continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in California, except where Apple's Standard EULA or applicable law requires a different forum.
